Trademark renewal is the legal process of extending the validity of your registered trademark beyond the initial 10-year period. The renewal can be filed anytime within six months before expiry or during the grace period of six months after expiry (with additional fees). If not renewed, the trademark becomes vulnerable to cancellation or removal from the registry.

What is Trademark Restoration?

If a trademark is not renewed in the prescribed time period, it will be removed by the Registrar. Trademark restoration refers to the process of reinstating a trademark that has been removed from the trademark register due to non-use or non-renewal. Thus, time is of essence in renewal of trademarks and shall be kept in mind. You should try to get your trademark renewed a few months before it expires. The validity of next 10 year will apply from the date of current validity.  

Trademark Renewal and Restoration Fees and Timeline

Until Date of Expiry – Rs. 9000

From Date of Expiry to Six months – Rs. 9000 + Rs. 4500 Surcharge

After Six months and-up to one year of Expiry – Rs. 9000 + Rs. 9000 penalty

For Instance, your mark is due to expire on 1 Jan 2026, the renewal and restoration will be done as follows:

Until 1 Jan 2026 – Standard Renewal (Rs. 9000)

2 Jan 2026 to 30 June 2026 – Renewal with surcharge (Rs. 13,500)

1 July to 31 Dec 2026 – Restoration (Rs. 18,000)

After 31 Dec 2026 – No renewal or restoration is allowed
